TERMS & CONDITIONS
GAZELLES DESTINATION - CANCELLATION, PAYMENT & REFUND POLICY:
By booking a trip with us, you are deemed to have agreed to these Terms and Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.
Article 1: Subject.
1.1)GAZELLES DESTINATION, which is mentioned below as The Agent, accepts to arrange and handle booking, mentioned below as The Client.
1.2) both parties have agreed for a tour to Morocco respecting below conditions
Article 2. : Confirmations - Retrocession Delays - Cancellation - No Shows.
2.1) Confirmation: this agreement means the definitive and binding confirmation by The Client, of the services and prices included in programmes submitted and approved by The Client.
2.2) Cancellation proceduresThe cancellation of confirmed travel arrangements, after a retrocession delay may involve some cancellation and no show fees. These are :
a). Between 74 and 50 days before the date of arrival, an amount of 45% of the whole proforma invoice will be invoiced.
b). Between 49 and 30 days, an amount of 60% of the whole proforma invoice will be invoiced.
c). Between 29 and 35 days, an amount of 75% of the whole proforma invoice will be invoiced.
d). For cancellation that happen 34 days before arrival, 90% of the whole proforma invoice will be invoiced.
2.3) No-Show: For cancellation on the day of arrival , the whole amount of the pro forma billinvoice will be charged.
2.4) Unused Services: If any confirmed services is not used for any reason, such as an early departure or a decision from the Client, the totality of services booked will be invoiced.
Article 3. General Conditions.
3.0) All rates are quoted in Dirhams ( or the equivalent in € - Euros, $ - US Dollars or in £ -UK Pound according to today exchange rates ), are NET to us and include all taxes applicable at the time of printing, unless otherwise mentioned.
3.1) Hotels booking Category & dislodging: We choose carefully the hotels we proposed according to their characteristics, degree of excellence and price performance. The category indicated for each hotel correspond to the official classification of the local Tourism authorities.
In case of no rooms, availability or dislodging guests are lodged in hotel of similar category. No refundable indemnity will be guaranteed in case of dislodging or changing hotel accommodation.
3.2) If we have not received a written confirmation for a booking by the time the option date is due, the reservation will be automatically cancelled. Similarly, all reservations will be voided if we have not received the necessary deposits within the stated times. If unforeseen circumstances beyond our control make changes necessary, we reserve the right to modify itineraries , and /or substitute hotels to a similar or superior grade. Clients cannot be refunded for unused services.
3.3) Gazelles Destination reserve the right to re-cost the tariffs indicated in the proposition in the cases here below : Change in the number of participants Change in the official rate of the Moroccan TVA Any measure taken by the Moroccan Government leading to a substantial increase in social charges.
3.4) Agent’s assistance: The Agent undertakes to assure all services as stipulated in the programmes and to provide all practical information before arrival of guests and when requested. During guests stay in Morocco and in case of an emergency, The Travel Shop is joinable 24/24 hours on mobile phones numbers. (These are available on request).
The Client agrees to inform the Agent of any particular medical problems, diseases, pregnancies or special meal treatments of the guests, before their arrival in the country. Failing to do so, The Agent declines all responsibility in case of health’s problem. The Agent may refuse the participation of some guests if it is proven that itinerary and programme offered are not adapted and incompatible with the local health conditions.
3.5) Gazelles Destination acts as an agent in making and securing all arrangements for transportation, sightseeing and accommodations for the program concerned. Gazelles Destination does not own or manage, control or operate any transportation vehicle, hotel, restaurant or any other supplier of service. Participants are subject to any terms or conditions of the supplier. By accepting tickets and vouchers, you that neither Gazelles Destination or any of its representatives shall be liable for any loss, injury or damage to you or your property or in connection with any accommodations, transportation or other services resulting either directly or indirectly from any occurrences beyond its control including breakdown of equipment, strikes, theft, delay or cancellation of or changes in schedule of services. Passengers are subject to all laws and customs in Morocco. Gazelles Destination reserves the right to decline, accept or retain a member of any tour. Gazelles Destination reserves the right to make necessary changes in itinerary or hotels or services, to substitute accommodations or any tour service.
Gazelles Destination reserves the right to cancel a tour at its own discretion in which case a full refund of monies paid will be made. Gazelles Destination cannot be held responsible for any events beyond its control, such as, without limitation, acts of God, war (declared or undeclared), terrorist activities, strikes or government restrictions, nor, in the absence of its own negligence, for personal injury, property damage or loss of earnings from any event (whatsoever) caused by persons not controlled by Gazelles Destination, including but not limited to employees of bus companies, hotels or restaurants. No employee or other representative may change the terms under which you agreed to participate. In purchasing a travel package through Gazelles Destination the passenger expressly agrees to the terms and conditions.
Article 4. Payment & booking Conditions:
4.1) Deposits Policy: A deposit on the total of Agent proforma invoice may be required upon confirmation of the programme and in accordance with deposits policy put in place by the suppliers, in order to garanty bookings. The payment schedule can be detailed as follows:
a). Upon confirmation of full programme 80% of total proforma to be paid 65 days before arrival.
b). Upon acceptance of the suggested itinerary and confirmation of full programme the total of the remaining balance is due to be paid to the agent at least 25 days before arrival.
4.2) Delays in Payments: Any delayed or remaining balance must be paid to the Agent before arrival of the guests in the country. In case of no respect of this payment schedule, The Agent will not be responsible for any dysfunction that would implicate. As a result it could create serious problems in terms of no respect of options, imposed by suppliers, which can resale the same services without a notice. Therefore, the Agent cannot provide the agreed services. All sum already paid may not be refunded.
4.3) Administration Fee: In case of a delay in payment, caused for any reason, there will be an administration fee fixed at 5% to be added to the delayed amount.
4.4) Bank Transfers: All bank transfers must be made by SWIFT. It is important that a copy of the SWIFT is sent either by fax or email to: The Travel Shop. This copy must clearly indicate the number of SWIFT, to allow tracing the money with the bank, as to minimise bank charges. Banking expenses of these transfers and any other differences due to the exchange rates variations, will be at the charge of the Client. All payment must be sent to :

4.6) Extra Services: All extras and supplementary services ordered during the travel and personal out of pocket expenses have to be paid directly by customers to concerned suppliers.
Article 5: Liabilities & Insurance
5.1) Responsabilities :
GAZELLES DESTINATION, is using different suppliers, which are fully insured individually in accordance with rules and third party liability. Consequently, The Travel Shop will not be held responsible of any accident, physical injuries, loss or missing personal effects and hand-luggage.
Gazelles Destination, is insured according to a legal article no: 2-97-547 of October 28, 1997. However, this insurance would in no case substitute itself to the individual civil responsibility insurance which each participant must be suscribe before arriving in Morocco . It is advisable to have a multi Risks guarantee that include also any cancellation fees, repatriation during the entire trip, medical expenses in the country, lost of luggage or travel documents.
Article 6 : Borders formalities.
6.1) Travel Documents Formalities. Customers must be in possession of passports and possible visas required for certain nationalities. The Travel Shop cannot be involved in any formalities related to visas required, necessary travel documents that may cause a refusal of the immigration authorities to accept any participants to enter the country. In some special cases, the Agent will assist its Client by some specific information, special documents to help ease the entrance to Morocco . Any such assistance must be requested in advance. In any circumstances, the Agent, can be held responsible of deported participants whose entrance to the Moroccan territory was refused.
6.2) Customs restrictions: The Travel Shop cannot be held responsible of any fulfilment of customs formality regulating the item’s import or export from Morocco . The Client can be made aware of specific customs regulations by asking the Agent before arrival in the country.
6.3) Weather conditions and General risks. The Agent cannot be held responsible for accidents due to the individual imprudence of a participant the tour. In case of unexpected sudden change of weather conditions, cancelled services will not be refunded.
The Agent declines all responsibility in cases of civil war, riots, strikes, possible military demonstration, requisitions, attempts, risks, temporary traffic interruptions, radiation, nuclear incident or what is usually known as “force majeure”. In these cases, there will be no compensation or refund acceptable.
6.4) Legal documents.
The agent is prepared to provide to its Client, all copies of original documents to prove that all the necessary official authorizations have been obtained and that the agent is fully licensed to legally practise.
All claims must be sent to The Travel Shop by registered mail or courier service, within one month following the return of the participants to their country. All litigations concerning the execution or the interpretation of the present agreement will be, in case of lack of amicable resolution, registered within the exclusive jurisdiction of the Tribunal de Première Instance in Tangier.
